These Official Rules (the "Rules") govern all giveaways, sweepstakes, drawings, raffles, and similar promotions (each, a "Promotion") conducted by Mystery Breaks ("Sponsor," "we," "us," or "our") on any platform where we host live streams, including Fanatics Live, Whatnot, eBay Live, and our own websites and social channels. By entering any Promotion, you agree to be fully and unconditionally bound by these Rules and the decisions of Sponsor, which are final and binding in all matters relating to the Promotion.
Each individual Promotion may have additional promotion-specific details — prize description, entry period start/end times, entry method, and number of winners — that will be announced by the host during the applicable live stream and pinned in the stream chat. To the extent any promotion-specific detail conflicts with these Rules, the promotion-specific detail controls only for that Promotion.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Void where prohibited or restricted by law.
For any Promotion conducted on or in connection with Fanatics Live, the following disclosure applies and is incorporated into these Rules in its entirety:
"NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. FANATICS LIVE IS NOT A SPONSOR, OR RESPONSIBLE FOR ANY ASPECT, OF THIS PROMOTION. BY ENTERING INTO THIS PROMOTION, YOU AGREE TO RELEASE FANATICS LIVE FROM ANY AND ALL LIABILITY ARISING OUT OF OR RELATED IN ANY WAY TO YOUR PARTICIPATION IN THIS PROMOTION. PARTICIPATION IN THIS PROMOTION CONSTITUTES ACCEPTANCE OF THE OFFICIAL RULES AND TERMS."
Fanatics Live, Whatnot, eBay Live, Instagram, TikTok, YouTube, and any other third-party platform on which a Promotion is conducted or promoted are not sponsors of, administrators of, or in any way responsible for any Mystery Breaks Promotion. Each Promotion is sponsored, administered, and operated solely by Mystery Breaks.
The Sponsor of all Promotions is Mystery Breaks. Mystery Breaks is solely responsible for the operation, administration, and legal compliance of each Promotion in every jurisdiction where it is offered. Questions about a Promotion should be directed to contact@mysterybreaks.com.
Each Promotion is open only to individuals who, at the time of entry:
Employees, contractors, officers, owners, and immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they live) and household members of Mystery Breaks and any company materially involved in the development, production, or administration of a Promotion are not eligible to enter or win.
Void where prohibited or restricted by law. All federal, state, and local laws and regulations apply.
Each Promotion will offer at least one Free Entry Method (an Alternative Method of Entry, or "AMOE") that is available during the entire entry period for that Promotion. Where a Promotion is connected in any way to a purchase, the Free Entry Method is offered with equal odds and equal weight as any other method of entry.
You may enter any Promotion for free, with the same odds of winning as any paid or purchase-linked method, using either of the following Free Entry Methods:
From time to time, a Promotion may grant entries in connection with a purchase (for example, a break spot that also enters the buyer into a separate prize drawing). In every such case, the Free Entry Method described in Section 5.1 is offered during the same entry period and provides equal odds of winning. Making a purchase will not increase your chances of winning.
Winners will be selected in a random drawing from among all eligible entries received during the applicable entry period. Where a Promotion is conducted live on stream, the random drawing may be conducted on camera using a transparent randomization method (such as a random number generator, wheel, or similar tool) that is shown to viewers.
Odds of winning depend on the total number of eligible entries received. Free Entry Method entries have the same odds of winning as any other method of entry.
Potential winners will be notified during the live stream, by direct message on the platform where the Promotion was conducted, or by email or phone using the contact information associated with the winning entry. A potential winner may be required to respond and confirm acceptance within seventy-two (72) hours of first notification and may be required to sign and return an affidavit of eligibility, a liability release, and (where lawful) a publicity release. If a potential winner cannot be reached, fails to respond within the required time, is found to be ineligible, or declines the prize, the prize may be forfeited and an alternate winner selected at Sponsor's sole discretion.
The prize(s) for each Promotion will be described by the host during the live stream and in the pinned chat message. Prizes are awarded "as is" with no warranty or guarantee, express or implied, by Sponsor.
Winners will not be charged shipping, handling, or any other fee in order to receive a prize from a Mystery Breaks Promotion. The only amounts a winner may be responsible for are any applicable taxes (see Section 8.2).
All federal, state, and local taxes (including income, sales, and use taxes) on the value of any prize are the sole responsibility of the winner. Where required by law, Sponsor will issue a Form 1099 to the winner reporting the approximate retail value of the prize, and the winner will be required to provide a completed IRS Form W-9 (including a valid taxpayer identification number) before the prize is released. Failure to provide required tax documentation within fourteen (14) days of request may result in forfeiture of the prize.
Prizes are non-transferable, non-assignable, and cannot be redeemed for cash. Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value if the advertised prize becomes unavailable for any reason.
By entering any Promotion, you:
Except where prohibited by law, by entering a Promotion, each entrant grants Sponsor and its designees the right to use the entrant's name, voice, likeness, biographical information, prize won, photograph, and statements made by or attributed to the entrant about the Promotion, the prize, or Sponsor, in any and all media now known or later developed, worldwide, in perpetuity, for advertising, promotional, marketing, and publicity purposes, without further notice, consideration, review, or approval.
Any personal information collected from entrants will be used by Sponsor to administer the Promotion, contact winners, and as otherwise described in our Privacy Policy. By entering a Promotion, you acknowledge and consent to Sponsor's collection and use of your information for these purposes.
The Released Parties are not responsible for: (a) any incorrect or inaccurate entry information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with the Promotion; (b) technical failures of any kind, including malfunctions, interruptions, or disconnections in phone lines, network hardware, or software; (c) unauthorized human intervention in any part of the entry process or the Promotion; (d) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or receipt or use or misuse of any prize.
If, for any reason, a Promotion is not capable of running as planned for reasons including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Promotion, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Promotion and, if terminated, to select winners from among all eligible, non-suspect entries received prior to the action taken.
In no event will the Released Parties be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, including but not limited to lost profits or lost opportunity, arising out of or related to a Promotion, even if advised of the possibility of such damages.
Mystery Breaks does not conduct lotteries. A lottery is a promotion that combines (i) a prize, (ii) chance, and (iii) required consideration (such as a required purchase or payment) without a free method of entry. Because every Mystery Breaks Promotion offers a Free Entry Method with equal odds of winning during the entire entry period (see Section 5.1), no Mystery Breaks Promotion is a lottery.
Each Promotion is void where prohibited or restricted by law. Sponsor will not award a prize to any winner whose residence is in a jurisdiction in which the Promotion is void. All federal, state, provincial, and local laws and regulations apply.
Except where prohibited by law, by entering a Promotion, you agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with a Promotion or any prize awarded shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Promotion, but in no event attorneys' fees; and (c) under no circumstances will any entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Rules or the rights and obligations of an entrant and Sponsor in connection with a Promotion will be governed by, and construed in accordance with, the laws of the United States and the State in which Sponsor maintains its principal place of business, without regard to its conflict of laws principles.
For a list of winners of any Promotion concluded within the last six (6) months, email contact@mysterybreaks.com with the subject line "Winners List" and the name and approximate date of the Promotion. Allow up to thirty (30) days for a response.
If any provision of these Rules is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.
Mystery Breaks is the Sponsor of each Promotion and is the only entity responsible for the operation, administration, and legal compliance of each Promotion. For questions about these Rules or any Promotion:
